Centers for Medicare & Medicaid Services (CMS)

US federal agency that runs Medicare and Medicaid and decides coding, coverage and payment for medical devices. It has no dedicated coverage pathway for implantable brain-computer interfaces, the gate that follows FDA approval.

Overview

The Centers for Medicare & Medicaid Services (CMS) runs Medicare and Medicaid and sets the codes, coverage rules and payment rates that private insurers often follow. FDA authorisation lets a device be sold. CMS decisions determine whether hospitals and doctors are paid to use it.

Where BCI stands

CMS has no dedicated coding, coverage or payment framework for implantable BCIs, a point a Health Affairs analysis pressed in March 2026. Stroke and ALS, two lead BCI indications, fall heavily on Medicare-age patients. After the GAO found developers struggled to engage the agency, CMS named a point of contact for BCI developers. The FDA’s Total Product Life Cycle Advisory Program now brings CMS into early talks for accepted devices, including CorTec’s Brain Interchange.

The neuromodulation precedent

The WISeR model, a CMS Innovation Center pilot running from 1 January 2026 to 31 December 2031 in six states, applies AI-assisted prior authorisation to 17 services, including deep brain stimulation, vagus nerve stimulation and hypoglossal nerve stimulation. Inspire Medical Systems, whose revenue comes entirely from hypoglossal nerve stimulation, cut its 2026 guidance to $825 million to $875 million and put the combined hit from WISeR and coding uncertainty at $120 million to $150 million. In the same rule cycle CMS raised professional payment for NeuroPace’s responsive neurostimulation implants by 43 per cent, and that therapy sits outside WISeR.

Why it matters

Neuralink engaged two federal lobbying firms at the end of April 2026, with “coverage of such devices” in the disclosed scope. Whether cortical BCIs are treated like Inspire’s therapy or like NeuroPace’s will shape their US revenue once FDA approvals arrive.
